Consistent with my desire to take personal responsibility for my conduct, I agree to abide by the governing documents and policies of MARKHAM WESLEY CENTRE (MWC hereafter). I will refrain from any form of discrimination, harassment, derogatory, illegal, or unethical conduct, and I understand that if I engage in such conduct, my membership may be revoked and I agree to reimburse MWC for any damages, losses, or costs resulting from my conduct. By submitting this application, I agree to the collection, use and processing of the personal information I provide to MWC in this Membership Application for the purposes of organization administration and payment of my dues. By submitting my personal information to MWC, I also agree that my information will be accessed and used by MWC and its employees and agents. I agree to notify MWC of any change to my personal information, including making any requests to check, delete or correct my personal information, so that it is accurate and current. I understand that the majority of the data requested in this application is necessary for administrative and planning purposes, and that failure to provide this information may prevent application from being properly processed.

I understand that my membership is only valid from the date of activation of my membership till the end of the current year.

I also understand that if I do not renew my membership by within three months from the expiry date, my personal information given in this Membership Application Form will be erased from MWC’s system, and my Membership No. will be cancelled. In order to retain my Membership No., I must submit a Membership Renewal Form to MWC within three months from the expiry date of my membership.

I understand that I must submit all of the missing portions of this application form (e.g. Personal Profile and Parental Consent) to MWC within ONE MONTH from the application date to be eligible for a membership card and to avoid termination of my membership.

WAIVER, RELEASE AND IDEMIFICATION

In consideration for permission from Markham Wesley Centre (MWC hereafter) to participate in program and in full recognition and appreciation of the dangers and risks inherent in the Activity, I hereby waive, release, and forever discharge MWC (and all of its affiliates, elected officials, directors, officers, employees, contractors, agents, volunteers and those for whom MWC is in law responsible) from and against any and all liability, claims, demands, actions, or causes of action for costs, expenses or damages to property or personal injury (including death) (collectively, “Liability”), which may result from my or my child’s participation in the Activity due to any cause whatsoever, including without limitation, negligence, or breach of any statutory or other duty of care on the part of MWC. I further hereby agree to hold harmless and indemnify the Releases from and against any and all Liability which may result from, or is in any way connected with, my or my child’s participation in the Activity.

ACKNOWLEDGMENT OF RISKS

I understand and acknowledge that participation in the Activity is voluntary. I understand and acknowledge that the Activity may be hazardous, that participation is solely at my own risk, and that I assume full responsibility for any injuries (including death) or damages resulting from my or my child’s participation in the Activity. I affirm that I am, and/or my child is, in good health and at an appropriate level of physical fitness and physical capability to participate in the Activity. I affirm that I am at least 18 years of age, or that I am the parent and/or legal guardian of the child listed below and I hereby consent to their participation and waive liability on their behalf.

CONSENT TO USE IMAGE

I hereby consent and authorize MWC to take my photograph/image and/or the photograph/image of the child listed below, for whom I am the parent and/or legal guardian (collectively, “Image”). I acknowledge and agree that MWC may publish, display or use the Image for any MWC purpose and by any means whatsoever including, but not limited to, electronic or digital means. I acknowledge that MWC may not be able to control the distribution or use of the Image by other than MWC representatives. I agree that this consent is given in perpetuity and for no consideration, credit, acknowledgement or financial recompense, now and in the future. I hereby waive, release, and forever discharge the Releases from and against any and all Liability whatsoever which may result from the taking, use, display, publication or distribution of the Image.

BY CHECKING THE BOX PROVIDED BELOW, THE PARTICIPANT / GUARDIAN ACKNOWLEDGES HAVING READ THIS DOCUMENT AND UNDERSTANDS THAT THE PARTICIPANT / GUARDIAN IS WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

REFUND POLICY

No refund will be given if the notice of withdrawal is not received at least one week in advance of class start date. If the program is cancelled due to insufficient enrollment or for other unforeseen circumstances, the registered participants will receive a full refund.

CLASS POLICIES

Participation in any MARKHAM WESLEY CENTRE (MWC hereafter) activities and/or using any of its recreational facilities may involve a risk of accidental injury, despite all safety precautions. Having been informed of the activities to be conducted by MWC, I/WE, as an individual, or as a parent or guardian of the participants named herein, assume all risks and hazards incidental to the activities, and release MWC from responsibility and agree to indemnify, defend and hold harmless (including the payment of attorney’s fees) MWC, its officers, directors, independent contractors, volunteers and all employees for any illness, death or injury to me, or my children, or family members occurring during his/her/our participation in any activities, or use of any recreational facilities, at or conducted by MWC.
